Child Custody Interviews
In certain cases, children who are 12 years of age or older will be interviewed so that they can express their desires for conservatorship or custody. Children who are under the age of 12 may be interviewed as well, at the discretion of the court. These interviews will help the court determine which parent will provide the primary residence of the child.
There are specific regulations that control how these types of interviews are conducted and how the information is handled. These interviews occur at the application of either party and can be performed by an amicus attorney or an attorney ad litem, who is appointed to the child by the judge. The child is interviewed by the judge in the presence of an attorney, an amicus attorney or an attorney or guardian ad litem.
If the child is 12 years old or older, these interviews will be recorded and added to the record in the case. Ultimately, the judge reserves complete discretion to decide what is in the best interest of the child.
